Bill 9 Implementation Update: Council Advances First Maui Vacation Rental Rezoning Resolutions

The Maui County Council voted 7-1 on July 24 to advance both Resolution 26-110 and Resolution 26-111, referring more than 2,000 apartment-district vacation rental units, according to estimates cited during Council testimony, to the Maui Planning Commission for potential rezoning into the county’s new H-3 and H-4 hotel districts. Council Member Keani Rawlins-Fernandez cast the lone “no” vote on both measures. Council Member Gabe Johnson was excused.

What the resolutions Resolution 26-110 and Resolution 26-111 do

Resolution 26-110 covers several special-property categories, including mixed timeshare and vacation-rental properties, properties consisting entirely of legally permitted timeshare units, leasehold properties, single-owner properties, and properties with variances allowing vacation-rental use. Resolution 26-111 covers properties the Council considers to operate in a hotel-like manner, based on features such as centralized front-desk or guest services, on-site management, housekeeping, groundskeeping, and other property-wide staffing.

It is worth restating a point we have made in earlier updates on this series: these resolutions are referrals, not final rezoning decisions. The Planning Commission will review the properties and make its own recommendation before the matter returns to the full Council for a final vote. Given that all three Planning Commissions previously recommended denial of the broader H-3/H-4 framework under Bill 88, continued scrutiny at this next stage should be expected.

What changed during the Maui Council’s July 24, 2026 review

Resolution 26-110:

  • Added four properties (Cook amendment)
  • Added seven more properties, and reorganized the resolution around clearer categories: single ownership, variance-allowed use, and 100% timeshare (Paltin amendment)
  • Removed Hale Ono Loa and Maʻalaea Kai, both no longer meeting leasehold criteria
  • Kauhale Makai was removed at committee, then added back on the Council floor. It is currently included.

Resolution 26-111:

  • Added three properties (Cook amendment)
  • Added Hana Kai-Maui (Sinenci amendment)
  • A motion to remove Luana Kai and Mahina Surf failed 2-6. Both remain included.

Where opinions stood at Maui Council

The Office of Hawaiian Affairs testified in opposition, arguing that removing roughly 2,056 units from the local housing pipeline is a significant, permanent decision. Rawlins-Fernandez, the lone dissenting vote, framed the question as one of housing supply for residents. Other testimony asked the Planning Commission be given adequate time to review the properties individually rather than as a package. We share this to give you a complete picture, not to characterize which position is correct.

What it means for owners and buyers

If your property, or one you are considering, appears on either list above, the practical next step is Planning Commission review, not an immediate change in zoning status. Hearings are anticipated to begin in September, though a specific schedule has not yet been announced. For any Minatoya List property, whether named in these resolutions or not, due diligence on zoning status, HOA health, and the fee simple versus leasehold distinction remains essential.
